The key points of evidence that is going to be presented are Sun and Oracle gave the Java language to the public, Google built Android using free and open technologies, and Sun publicly approved Android's use of Java. In a testimonial video Larry Ellison, CEO of Oracle, affirmed that nobody owned Java programming language and that there is no royalty. Also, Ellison stated separately that he is "giving Java to the world." Since Mr. Ellison stated that Java is for the world, Google feels like they have not infringed upon any patents. To expand upon this on Oracle's website it states that the java language API package "provides classes that are fundamental to the design of the Java programming language."
